Sales conditions

1- Reservation

Access to the Villa is only granted to guests who have received a written confirmation of their reservation, after receipt of the deposit , which is 40% of the total amount of the booking, within a maximum of fifteen days from the date of confirmation. For reservations made one month before the arrival date, the total amount of the booking is due upon confirmation. Abalya reserves the right to cancel any reservation if the deposit or full payment is not received prior to the arrival date . The payments are to be made by wire transfer or credit card.

 2- Payment of the balance

The balance must be paid no later than three weeks before your arrival date. Failure to pay the balance in due time immediately cancels the reservation .

3- Cancellation policy

If guests wish to cancel their reservation, for any reason, they are subject to a penalty depending on the cancellation date on which the written request is received by Abalya :

  • More than 60 days before the starting date of the stay: 10% of the total amount of the rental.
  • From 60 to 45 days before the starting date of the stay: 25% of the total amount of the rental.
  • From 45 to 30 days before the starting date of the stay: 50% of the total amount of the rental.
  • Less than 30 days before the starting date of the stay: 100% of the total amount of the rental.

4- Cancellation by Abalya

The following clause is only valid for reservations that are confirmed and paid. In the rare event of a cancellation or amendment of the reservation by Abalya, guests will be notified and granted a full refund of the amount already paid for the reservation. If possible, Abalya will offer guests an alternative solution of the same category or a higher category without any price change.

 5- Provision of the Villa

Depending on the selected formula, the Villa booked is made available to guests in its integrity or in part, at 3pm on the arrival date, and must be vacated at 12pm on the day of departure. Requests for early check-in or late check-out are subject to availability, and can be granted for an extra cost. Upon arrival, a police form must be filled by all guests, in accordance with the hotel regulations in effect.

 6- Rental conditions

Abalya strives to provide an exceptionally safe and friendly experience to all guests. Every guest is, therefore, required to preserve this dignified atmosphere by avoiding disturbance of the other occupants and neighboring villas. Proper attitude and respect towards the staff at your disposal are required within the Villa. Animals are forbidden. The Villa is rented only as a temporary and recreational residence, any sublease is prohibited. Guests may verify that their holiday insurance is valid in Morocco. Damages on site will be billed at their replacement value or cost of repair. Similarly, objects or equipment, broken or deteriorated beyond regular deterioration, as well as accessories made dirty, will be subject to compensation. Guests are under the obligation to notify, as soon as it is discovered, any loss in the Villa and accessories. Guests cannot oppose a visit to the premises by Abalya or their representative when they make the request. An adversarial inventory will be established at the beginning and end of the stay. The security deposit, for events or use of equipment, will be refunded on the departure date, if no damage has been caused to the villa or said equipment.

 7- Responsibilities 

Abalya and the Villa domains, as well as their staff, cannot be held responsible for any accident with direct or indirect consequences, which may occur to property and/ or to persons , in the rented Villa or in the area of ​ rented villa. Abalya expressly informs guests that the pools of the domain, private and common games areas for children, the playing fields (tennis, football, handball, basketball, petanque (if any) etc…) are not monitored. Their use is under the sole responsibility of guests. Abalya recommends the utmost vigilance regarding the use of swimming pools by children. Children are under the sole and complete responsibility of their parents or occupants who take care of them. Guests are not to allow children to use the pools, games and playgrounds alone, and assume all responsibilities in this respect. Similarly, neither Abalya nor the Domain can be held responsible in the event of interruption or failure of services such as water, electricity, gas.

Personal property is under the sole responsibility of the guests. Nonetheless, secured safes are available in the Villa reserved for any valuables. If a responsibility is recognized at the expense of Abalya when a decision of justice becomes final, the amount of the compensation can not exceed the total cost of the stay paid by the guest.

 8- Provision of a Vehicle

An adversarial statement and a contract of provision will be established through a car rental company. The driver is required to have a valid driver’s license and comply with the traffic regulations in Morocco. Any off-road use is strictly prohibited. Guests must return the vehicle in the condition it was received, and answer for any damage to the vehicle.

 9- Access to the common areas of the domain 

We recommend approaching the host manager and referring to the regulation in effect at the domain.

 10- Guests

All domains are guarded 24/7. Only owners and guests have permanent access. As a result, guests must notify Abalya of any exterior guests at least 24 hours before their arrival. The full identity of the guests will be requested and may be verified. The host manager and the domain guardian reserve the right to refuse entry to any guest, without justification, even when the permission was granted beforehand. The present contract as well as the internal rules of the domain are applicable to all guests. Exterior visits are restricted beyond 10pm for security reasons.

 11- Termination 

Signing the rental contract indicates the unconditional acceptance of these Terms and Conditions on behalf of all guests included in the booking. Failure to comply with the General Terms and Conditions may result in immediate termination of the rental agreement, without any refund. In this case, all guests must leave the Villa within two hours of notification by the host manager.

 12- Attribution of jurisdiction

In the event of a dispute concerning these terms and conditions, the competent courts of Marrakech (Morocco) shall have exclusive jurisdiction.

13- Failure to pay: 

In case of payment failure, we reserve the right to initiate legal proceedings to recover the debt incurred without further notice, in addition to a fixed penalty of 15%. Legal action may result in guests being obliged to pay legal costs of both parties and interest in addition to lasting impact on their credit history.
